Conditional caution powers to local authorities for fly-tipping offences

Overview

Summary

We are proposing to give local authorities powers to issue conditional cautions, to help them tackle fly-tipping.

Consultation description

We want to know what you think of introducing powers for local authorities to issue conditional cautions to fly-tipping offenders. These cautions are one of a range of pre-court community-based sanctions.

We want your views on how these cautions could be enforced, including whether to prosecute offenders who fail to comply or only partially comply.

We also want to know if you can share information on the likely:

  • impact on prosecutions

  • implementation requirements

  • costs and potential savings from offender-led clean-up work

  • organisations best placed to supervise such activity

We would also like your views on any unintended or environmental consequences, and whether alternative measures would be more effective at deterring fly-tipping.

Crynodeb

Rydym yn cynnig rhoi pwerau i awdurdodau lleol roi rhybuddion amodol, i’w helpu i fynd i’r afael â thipio anghyfreithlon.

Disgrifiad o’r ymgynghoriad

Mae arnom eisiau gwybod beth ydych chi’n ei feddwl am gyflwyno pwerau i awdurdodau lleol roi rhybuddion amodol i droseddwyr sy’n tipio’n anghyfreithlon. Mae’r rhybuddion hyn yn un o amrywiaeth o sancsiynau cymunedol cyn mynd i’r llys.

Mae arnom eisiau clywed eich safbwyntiau am sut gellid gorfodi’r rhybuddion hyn, gan gynnwys a ddylid erlyn troseddwyr sy’n methu â chydymffurfio neu sydd ond yn cydymffurfio’n rhannol.

Mae arnom hefyd eisiau gwybod os gallwch chi rannu gwybodaeth am y canlynol:

  • yr effaith debygol ar erlyniadau

  • y gofynion gweithredu tebygol

  • y costau tebygol a’r arbedion posibl drwy waith glanhau gan droseddwyr

  • y sefydliadau sydd yn y sefyllfa orau i oruchwylio gweithgarwch o’r fath

Byddem hefyd yn hoffi clywed eich barn ar unrhyw ganlyniadau anfwriadol neu amgylcheddol, ac a fyddai mesurau eraill yn fwy effeithiol i atal tipio anghyfreithlon.
